⚖️ Agreement Summary: By downloading, accessing, or using Botel Chat, you agree to be bound by these Terms and Conditions. You must be at least 18 years of age to use this platform.
1. Eligibility & Age Restriction (Strictly 18+)
Botel Chat is designed strictly for adults. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account or use our services. By creating an account or accessing the app, you represent and warrant that:
- You are at least 18 years old.
- You have the full legal capacity and authority to enter into this binding agreement.
- You have never been convicted of a sexual offense, harassment, or violent crime.
- You have not been previously banned or removed from Botel Chat for violating our terms or community guidelines.
2. Account Creation & User Responsibility
When creating your profile on Botel Chat:
- One Account Per Person: You agree to maintain only one active account. Automated creation of multiple accounts or botting is strictly prohibited.
- Authentic Identity: You must provide accurate and authentic profile details. Impersonating another person, brand, or celebrity is grounds for immediate termination.
- Account Security: You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
3. Zero Tolerance for Prohibited Conduct & Child Protection
🚫 ZERO TOLERANCE: Botel Chat enforces an absolute zero-tolerance policy towards Child Sexual Abuse Material (CSAM), Child Sexual Exploitation and Abuse (CSAE), non-consensual sexual content, terrorism, hate speech, and harassment. Any violation results in immediate permanent account ban, hardware device ban, and reporting to law enforcement authorities.
You strictly agree that you will NOT:
- Upload, share, transmit, or solicit any sexual content involving minors. We may preserve relevant evidence and report confirmed illegal content to appropriate authorities where required.
- Harass, stalk, intimidate, bully, threaten, or defame any user.
- Solicit money, bank transfers, cryptocurrency, gift cards, or financial investments from other users (anti-scam enforcement).
- Transmit spam, malware, spyware, phishing links, or unauthorized promotional material.
- Reverse-engineer, decompile, scrape, index, or attack the Botel Chat application or its APIs.
4. Virtual Goods, Coins & In-App Purchases
Botel Chat features an in-app virtual economy including Coins, Diamonds, and VIP Memberships:
- Limited Virtual Licence: Coins and diamonds represent a limited, non-exclusive, non-transferable, revocable licence to access digital animations, 3D gifts, and premium features within the app.
- No Real-World Cash Value: Virtual items are NOT real money and have no cash value. They cannot be exchanged, redeemed, or refunded for fiat currency under any circumstances.
- Google Play Billing: All purchases are processed exclusively through Google Play In-App Billing. We do not process or store your payment card details directly.
- Non-Refundable: Once virtual coins are expended on in-app gifts, games, or features, the transaction is final and non-refundable.
- Forfeiture Upon Ban: If your account is terminated for violating these Terms or engaging in abusive behavior, all remaining virtual coin balances and memberships are immediately forfeited without reimbursement.
5. User Content & Intellectual Property
You retain ownership of the photos, bio descriptions, text messages, and audio intros that you upload to Botel Chat. However, by uploading content, you grant Botel Chat a worldwide, royalty-free, sublicensable licence to host, store, cache, display, and transmit such content solely for the purpose of operating and providing the service to you and your selected recipients.
You warrant that your content does not infringe the copyright, trademark, privacy, or publicity rights of any third party.
6. Voice Rooms, Games & Real-Time Communications
Our interactive features (Voice Rooms, Ludo, Dots & Boxes, Carrom, Jungle Chess) are provided for friendly social entertainment. In voice rooms and gaming sessions:
- Do not broadcast abusive, offensive, defamatory, or copyright-infringing audio.
- Collusion, cheating, automated clickers, or exploiting bugs in game scoring is strictly prohibited.
7. Termination & Account Deletion (Right to Erasure)
You may terminate your account at any time directly through the app via Profile ➔ Settings ➔ Delete Account or via our online Request Account Deletion portal. Upon deletion, your profile data, chat history, and stored media are permanently purged in accordance with India's DPDP Act, 2023.
Botel Chat reserves the right to suspend, terminate, or ban your access at our sole discretion, without notice, if we believe you have breached these Terms, posed a safety risk to our community, or violated applicable law.
8. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BOTEL CHAT DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS, BOTH ONLINE AND OFFLINE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTEL CHAT AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and rules framed thereunder. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in India.
